Waiver of Liability and Right of Refusal to Serve

I hereby acknowledge and agree to the following terms and conditions as a condition of my presence at The Island Club at North Captiva located at 5576 Doug Taylor Cir, Saint James, FL 33956.

Assumption of Risk

I understand and acknowledge that my presence at The Island Club at North Captiva involves certain risks and dangers, including but not limited to risks associated with outdoor and water activities, wildlife encounters, and the natural environment of an island setting. I voluntarily assume all risks associated with my presence on the premises, understanding that these activities may involve a risk of physical injury or other harm.

Waiver of Liability

In consideration of being permitted to enter and remain on the premises of The Island Club at North Captiva, I hereby release, discharge, and hold harmless The Island Club at North Captiva, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or anyone who I have purchased tickets for using this form whether caused by the negligence of The Island Club at North Captiva or otherwise.

Right of Refusal

The Island Club at North Captiva reserves the right to refuse service to any guest for any reason, including but not limited to intoxication, disruptive behavior, failure to comply with club rules and policies, or any actions that threaten the safety or enjoyment of other guests or staff. Any guest who violates the rules and policies of The Island Club at North Captiva may be asked to leave the premises immediately without any form of refund or compensation.

Governing Law

This waiver of liability and right of refusal shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under or connected in any way to this agreement shall be resolved in the appropriate courts located in Florida.

By signing below, I acknowledge that I have read and understood this waiver of liability and right of refusal, and agree to its terms and conditions voluntarily.
